| Abstract: | إن مصطلح المنافسة الحرة يعتبر من أهم المصطلحات الحديثة والمتداولة في الحياة اليومية، حيث يسعى طرفين اقتصاديين لتحقيق هدف مماثل فتنشأ رغبة لكل طرف في التغلب على الأخر بكل الطرق و الأساليب غير المشروعة، وعليه ولحماية المنافسة فقد سن المشرع الج ا زئري جملة من النصوص القانونية 02 المتعلق \ 03 المتعلق بالمنافسة والقانون 04 \ التشريعية والتنظيمية في مجال المنافسة أهمها الأمر 03 بالممارسات التجارية كما أكد تجريم المضاربة غير المشروعة بشتى صورها وأساليبها كونها تمس بحرية المنافسة، حيث تضمنت هذه القوانين مجموعة من المبادئ والقواعد التي تحكم شروط المنافسة ومن خلال هذا وحتى يكون استق ا رر تجاري فإن المشرع حاول ردع مختلف هذه الج ا رئم محاولا منه الحفاظ على المناخ التنافسي القائم رغبة في تنمية وحماية المنافسة وبعث الثقافة التنافسية |
