| Abstract: | تتناول هذه الدراسة موضوع تحقيق العدل في المحاكمة الإلكترونية في المادة الجزائية في القانون الجزائي من خلال صدور القانون 15\03 المتعلق عصرنة العدالة ،وأيضا من خلال التعديل القانوني للأمر 20/04 المتضمن قانون الإجراءات الجزائية المعدل والمتمم وذلك حيث أن هذه التقنية قد حققت نتائج إيجابية تهدف إلى تطوير الخدمات العدلية بدءا بسرعة انجاز المعاملات وتقليل مدة مواعيد جلسات المحاكمة والولوج لمفهوم المحاكمة الإلكترونية وصولا لتحقيق مبدأ المحاكمة العادلة في المحاكمات . ولا ريب أن اعتماد تقنية متطورة ومواكبة لعصرنة العدالة سيساعد بشكل واضح في تقليل الاعباء المادية على أطراف الدعوى وبالاضافة إلى ذلك تتمثل أهمية هذه الدراسة في سعيها لتسليط الضوء على مشروعية المحاكمة الإلكترونية في الحفاظ على ضمانات المحاكمة العادلة في تحقيق أهم مبدأ للعدالة وهو مبدأ تحقيق العدل والتي من شأنها أن تحدث تغيير جذريا في نظام العدالة الجزائية . وعلى هذا الأساس تناولت في هذه الدراسة من ناحية الايطار العام حول تقنية المحاكمة الالكترونية مع جمع كل ما يتعلق بها في ماهيتها في الفصل الأول ثم جمعت كل ما يتعلق بجانبها الإجرائي وضماناتها لتكريسها لمبادئ المحاكمة العادلة وأثرها في الفصل الثاني. تهدف هذه الدراسة إلى عرض ما يتعلق بنجاعة المحاكمات الإلكترونية في تطبيق جميع الضمانات لتحقيق محاكمة عادلة في المادة الجزائية في القانون الجزائري من خلال تفعيل إجراءات هذه التقنية الحديثة تقنية المحاكمة عن بعد التي كرسها المشرع الجزائري بموجب القانون 15-03 المتعلق بعصرنة العدالة والتي تم العمل بها بصفة قليلة إلا أنه مع تفشي جائحة كورونا ونظرا للظروف الإستثنائية التي حلت على العالم أجمع أصبحت هذه التقنية ضرورة حتمية في حسن سير العدالة .وقد أخذت العديد من الدول بهذا النظام وتطبيق هذه التقنية ومن بينها الجزائر . |
| Description: | This study deals with the issue of achieving justice in the electronic trial in the penal article in Algerian law through the issuance of law 15/03 on the modernization of justice and also through the legal amendment of ordinance 04/20 containing the amended and supplemented code of criminal procedure ; this is as this technology has achieved positive results aimed at developing judicial services, starting with the speedy completion of transaction ,and accessing the cancept of electronic trial , in order to achieve the principle of fair trial in trials. This is no doubt that the adoption of advanced technology that keeps pace with the modernization of justice will clearly help in reducing the parties to the case. In addition, the importance of this study is in its quest to shed light on the legality of electronic trial in maintaining the guarantees of a fair trial in achieving the most important principal of achieving justice , which that would fundamentally change the criminal justice system. On this basis ,i dealt with in this study in terms of the general framework about the electronic trial technology with collecting everything related to its nature in the first chapter, then collected everthing related to its procedural aspect and its guarantees to devote it to the principles of fair trial and its impact in the second chapter. This study aims to present what is related to the efficacy of electronic trials in applying all guarantees to achieve a fair trial in the penal article in algerian law by activating the procedures of this modern technology ,the remote trial technique that was dedicated by the algerian legislator under law 15/03 related to the modernization of justice, which has been implemented in a small way ,but with the outbreak of the corona pandemice , and due to the exeptional circumstances that have befallen the whole world,this technology has become an imperative in the proper course of justice , and many countries have taken this system and applied this technology, including algeria. |
