| Abstract: | من خلال بحثنا هذا تناولنا نظام الوساطة الجنائية الذي استحدثه المشرع الجزائري بمقتضى القانون12/15المؤرخ في 15 يوليو 2015 المتعلق بحماية الطفل الذي يضمن وضع حد نهائي للإخلال الناتج عن الجريمة التي ارتكبها الطفل الجانح من جهة و ضمان جبر الضرر الذي يصيب الضحية من جهة أخرى و ذلك في إطار إرساء مبادئ المحاكمة العادلة دون الإخلال بأهم حقوق الطفل المتمثلة أساسا في احترام قرينة البراءة و حقه في الدفاع و حضور وليه الشرعي خلال جميع مراحل إجرائها ، وتعد الوساطة الجنائية أحد صور نموذج العدالة التصالحية التي تسعى لإيجاد سبل لتقويم سلوك الطفل الجانح قصد إعادة تأهيله و إدماجه اجتماعيا بغرض إنهاء النزاع بين الطرفين بطريقة ودية بين الطفل الجانح و الضحية عرفت العديد من التشريعات الوساطة الجنائية كما فعل المشرع الجزائري في قانون حماية الطفل حيث أعطى تعريفا دقيقا مع ضرورة تمييز هذا النظام عن المصطلحات المشابهة لها، كما تتميز الوساطة بمزايا كالسرية وتخفيف العبء عن القضاء، وذهب الفقهاء الى تحديد الطبيعة القانونية للوساطة الجنائية ، أما تكلمنا عن الطفل فقد تضمنه قانون حماية الطفل من خلال المادة 02 منه وحدد إجراءاتها وكيفية إعداد مراحلها مع ما تنتجه من آثار على الدعوى العمومية. |

During all stages of itsconduct, criminalmediationis one of the forms of restorative justice model thatseeks to findways to correct the behavior of the childwhoisdelinquent in order to rehabilitatehim and socializehimwith a view to ending the conflictbetween the parties in a friendlywaybetween the childoffender and the victim has knownmanylegislationcriminalmediation as the Algerian legislatordid in the child protection law, wherehe gave an accuratedefinitionwith the need to distinguishthis system fromsimilarterms,Mediationalso has advantagessuch as confidentiality and the easing of the burden on the judiciary, and juristswent on to determine the legal nature of criminalmediation, but wetalked about the childwasincluded in the Law on the Protection of the Child through article 02 of it and specifieditsprocedures and how to prepareits stages with the effectsitproduces on the public prosecution. |
