| Abstract: | ''العدل أساس الحضارات'' مقولة خلدها التاريخ وساهمت في بناء أرقى الأمم على مر العصور، كون العدل هو الأساس والبنيان الذي تقوم عليه دولة القانون، ولا يتحقق العدل إلا عن طريق القضاء، من خلال فرض سلطان القانون وإستقلالية القاضي وحياده، حتى يضمن للمتهم محاكمة عادلة تخلو من التحيز والشك، وفي سبيل تحقيق ذلك أقر المشرع الجزائري على غرار باقي التشريعات الأخرى ضمانات تقيد القضاة في حد ذاتهم، ولعل أبرز هذه الضمانات هي نظام رد القضاة في المادة الجزائية، حيث يتم هذا النظام برد قاضي عن النظر في دعوى ما نتيجة لعدة أسباب مقررة قانونا كصلته بأحد الخصوم، وذلك حماية للمتهم من جهة، وللقضاء في حد ذاته من جهة أخرى، وقد المشرع هذا النظام بإجراءات صارمة حتى لا يتم التلاعب به من طرف أطراف الدعوى وفرض عقوبات على من يستهزأ به، كونه يمس بشرف وحياد القاضي. |
