| Abstract: | موضوع احالة الدعوى العمومية على محكمة الجنح يتكون من فصلين: الفصل الأول تناولنا فيه طرق احالة الدعوى العمومية عن طريق الاستدعاء المباشر باعتباره من الاجراءات البسيطة و كذلك عن طريق اجراءات المثول الفوري حسبما جاء به الأمر 15/02 السالف الذكر في الجرائم المتلبس بها هدف تشريع اجراءات المحاكمة و كذا الأمر الجزائي باعتباره من الإجراءات الموجزة التي تبناها المشروع لتسهيل الفصل في القضايا. أما الفصل الثاني تناولنا فيه الاحالة من جهات التحقيق من طرف قاضي التحقيق من طرف قاضي التحقيق باعتباره درجة التحقيق الأولى وغرفة الاتصال باعتباره درجة تحقيق أو ثانية التحقيق. وكذا من طرف الشخص المضرور والاحالة من المحكمة العليا بعد النقص. |
| Description: | The subject of the referral to the criminal court of the public case comprises two chapters: The first chapter dealt with the procedures for referral to the public case by direct summons, since it is one of the simple procedures, as well as by the procedures for immediate appearance, as set out in Order 15/02 cited above in matters of flagrante delicto aimed at legislating trial procedures, as well as the penal order as one of the summary procedures adopted The project aimed at facilitating the trial of cases. As for the second chapter, we dealt with referral to the investigating authorities by the investigating judge by the investigating judge as the first level of instruction and the communication room as the level of instruction or second instruction. As well as by the aggrieved person and the removal from the Supreme Court after the shortage. |
