| Abstract: | إنّ الحريات الفردية تعتبر من أهم المواضيع التي اهتم بها المشرع الجزائري وأولاها عناية خاصة، كما أقرّتها الإعلانات والمواثيق الدولية كون هذه الحريات لصيقة بحياة الفرد الخاصة، وأي اعتداء واقع عليها يعتبر اعتداء على حياة الفرد وهو ما جرّمه المشرع الجزائري وأقرّ له عقوبات صارمة بموجب قانون العقوبات وبعض القوانين الخاصة المستحدثة كقانون الوقاية من التمييز وخطاب الكراهية ومكافحتهما، وقانون الوقاية من جرائم اختطاف الأشخاص ومكافحتها، وهذا نظراً لتفشي مثل هذا النوع من الاعتداءات وسعي المشرع الجزائري للحد منها باستحداث آليات وقوانين تحمل إجراءات وعقوبات رادعة |
| Description: | Individual freedoms are deemed one of the major issues that the Algerian legislator focused on as they are recognized by the international declarations and charters. And since these freedoms are serious, any sort of violation towards them means violating one's life and this is definitely criminalized by the Algerian legislator. This latter introduced severe penalties according to the Penal Code and other specific laws adapted such discrimination and xenophobia law, and kidnapping law, in response to the spread of this sort of violations and thus the Algerian legislator sought to reduce them with strict mechanisms and laws. |
