| Abstract: | يعد التجريم الوقائي من ابرز مظاهر التجديد في السياسة الجزائية المعاصرة، حيث انصرفت عديد التشريعات الجزائية على غرار المشرع الجزائري إلى تجريم بعض صور السلوك الذي يحمل في طياته مخاطر يمكن أن تصيب الحقوق والمصالح التي يحميها القانون الجزائي بالضرر، تأكيدا على أن دور القانون لا يتدخل بعد وقوع الجريمة لمعاقبة الجاني فحسب، بل يمكن أن يتدخل قبل وقوع الجريمة، الأمر الذي أدى إلى ظهور بجانب جرائم الضرر طائفة أخرى من الجرائم يطلق عليها جرائم الخطر، وبذلك يعد التجريم الوقائي صورة واضحة للتطور الذي وصل إليه المشرع الجزائي الجزائري. |
| Description: | Preventive criminalization is one of the most important aspects of modern penal policy. many criminal laws. such as the Algerian legislation. have criminalized certain forms of behavior that carry risks that could affect the rights and inters protected by criminal law. emphasizing that the role of law does not interfere only after the crime to punish the perpetrator. but it can intervene also before the crime. this situation led. Beside crimes that cause damage. to the emergence of another from of crimes that can be source of danger. Thus. preventive criminalization is a clear view of the evolution of Algerian criminal law. |
