| Description: | This study came as a descriptive and analyticalresearch on the issue of criminal protection for fetuses, by answering the followingquestion:What are the legalmechanismsguaranteed by the Algerian legislator for the criminal protection of the fetus? By reviewing the legislativetexts and laws on the subject of abortion, wefindthat the legislator has criminalized the act of abortion regardless of itsmeans and regardless of the perpetrator, whether the pregnantwomanherself or someoneelse, in order to protect the right of the fetus to life. The penalty for the crime of abortion ranges from a misdemeanor to a felony in the case of a felonyDeath. While the Algerian legislationpermitted the act of abortion in an exceptional case, whichis a medicalnecessity for fear of the mother's life and health. Likewise, the legislator'scriminalization of abortion did not differentiatebetweennaturalpregnancy and pregnancy or artificialinsemination. |
