| Abstract: | تعتبر جریمة الاستعمال التعسفي لأموال الشركة من بین إحدى الجرائم الحدیثة نسبیا التي عرفتھا الشركات التجاریة، حیث برزت خطورة ھذه الجریمة علیھا وبالتالي على اقتصادیات ونمو البلدان على حدٍّ سواء، وذلك من خلال الآثار السلبیة التي ازدادت من جرّاء تزاید ارتكاب هذه الأخیرة. وعليه فإن جريمة الاستعمال التعسفي لأموال الشركة من أخطر الجرائم التي تؤثر على سيرالشركات التجارية باعتبار هذه الأخيرة العمود الفقري لاقتصاد الدول و نظرا لارتباط جريمة الاستعمال التعسفي لأموال الشركة بالنصوص التجريمية لجريمة خيانة الأمانة هذه الأخيرة التي باتت لا تستوعبها مما سهل على المسيرين الإفلات من العقاب و من اجل ذلك أصدر المشرع الجزائري تعديلا بموجب الأمر75-59 المعدل و المتمم للقانون التجاري الجزائري؛ حيث اعتبرها جريمة خاصة مستقلة بذاتها و بشروطها الخاصة. |
| Description: | The crime of abusive use of company funds is among one of the relatively recent crimes that commercial companies have known, as the seriousness of this crime has emerged against them and thus on the economies and growth of countries alike, through the negative effects that have increased as a result of the increased commission of the latter. Accordingly, the crime of arbitrary use of company funds is one of the most serious crimes that affect the functioning of commercial companies, as the latter is the backbone of the economy of countries, and due to the link between the crime of arbitrary use of company funds and the criminal texts of the crime of breach of trust, which the latter does not understand, which makes it easier for the facilitators to escape punishment and from For that reason, the Algerian legislator issued an amendment pursuant to Ordinance 75-59 amending and supplementing the Algerian Commercial Code; Where he considered it a special crime, independent of itself and on its own terms |
