| Abstract: | مبدأ إقليمية القانون الجنائي يعني أن القانون الجنائي للدولة يسرى على كل الجرائم التي ترتكب داخل إقليمها بغض النظر عن جنسية مرتكب الجريمة أو مكان وجوده، ولا يتعداه إلى غيره من أقاليم الدول الأخرى. ووفقًا لمبدأ الإقليمية فإن الحدود المكانية للنص الجنائي تنتهي بالحدود المكانية التي تفرض الدولة عليها سيادتها كما يقوم على أساس الاختصاص المطلق للدولـة ولقـضائها ولقوانينها الجنائية حيال الأفعال المعاقب عليها التي ترتكب على إقليمهـا على خلاف بقية المبادئ الأخرى المتمثلة في مبدأ العالمية، العينية والشخصية، كما أن من بين الجرائم المستحدثة التي ينطوي تطبيقها ضمن مبدأ اقليمية القانون الجنائي نجد الجريمة الالكترونية، حيث تتخذ هاته الجريمة الفضاء الإفتراضي مسرحًا لها وهو ما دفع بمختلف التشريعات إلى سن قوانين لمكافحتها اقليميا وعالميا |
| Description: | The principle of territoriality of criminal law means that the criminal law of a state applies to all crimes committed within its territory, regardless of the nationality of the perpetrator or his location, and does not extend to other territories of other states. In accordance with the principle of territoriality, the spatial boundaries of the criminal text end with the spatial boundaries over which the state imposes its sovereignty. Among the new crimes that involve their application within the principle of regional criminal law, we find electronic crime, as this crime takes the virtual space as its scene, which prompted various legislations to enact laws to combat it regionally and globally |
