| Abstract: | إثر تعديل قانون العقوبات 2006 في العقوبة التكميلية وهي حل الشخص الاعتباري وأضاف إليها عقوبات أخرى منها كانت عقوبة تبعية وحولها إلى عقوبة تكميلية تتمثل في الحجر القانوني والحرمان من الحقوق الوطنية تصبح الحرمان من الحقوق الوطنية والمدنية بصيغتها الجديدة، وبعضها كانت تدابير أمن شخصية كالمنع المؤقت من ممارسة المهنة أو نشاط وإغلاق المؤسسة نهائيا أو مؤقتا، وبعضها كانت عقوبات مستحدثة كالحظر من إصدار الشيكات أو استعمال بطاقات الدفع والإقصاء من الصفقات العمومية. وألغى المشرع العقوبات التبعية نهائيا وإدماجها في العقوبات التكميلية، كما ألغى تدابير الأمن العينية وتدبير بين التدابير الشخصية ليدمجها في العقوبات التكميلية. |
| Description: | Following the amendment of the Penal Code 2006 in the complementary penalty, which is the dissolution of the legal person, and added to it other penalties, including an accessory penalty and transformed it into a complementary penalty represented in legal quarantine and deprivation of national rights, the deprivation of national and civil rights in its new form, and some of them were personal security measures such as temporary prohibition from exercising The profession or activity and closing the institution permanently or temporarily, some of which were new penalties such as banning from issuing checks or using payment cards and exclusion from public transactions. The legislator abolished the accessory penalties permanently and incorporated them into the complementary penalties, as well as the security measures in kind and a measure between personal measures to be incorporated into the complementary penalties. |
