| Abstract: | يعد موضوع الحماية الجنائية للمعطيات الشخصية من أكثر المواضيع القانونية أهمية، و لقد حاولنا في هذه الدراسة استعراض جوانب هذه الحماية الجنائية التي أقرها المشرع الجزائري من خلال القانون 18/07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي، و الذي وفق إلى حد بعيد في حمايتها من مختلف الاعتداءات عند معالجتها، سواء منها ما تعلق بالشق الموضوعي للمعالجة أو تلك المتعلقة بشقها الشكلي. فالجوانب الموضوعية للمعالجة تشمل كل ما يلزم مراعاتها عند القيام بكل معالجة إلكترونية للمعطيات الشخصية، سواء تعلقت هذه القواعد بتسيير المعطيات ذات الطابع الشخصي، أو تعلقت بحقوق الشخص المعني، و التي وضعها المشرع لتمكين الشخص المعني من حماية حياته الخاصة من كل اعتداء قد يطالها من جراء المعالجة، و كل مخالفة لهذه الحقوق يعتبر جريمة معاقب عليها. أما الجوانب الشكلية للمعالجة هي تلك القواعد الشكلية التي وضعها المشرع الجزائري بهدف حماية البيانات الشخصية في مواجهة هذه المعالجة، حيث ألزم المسؤول عن المعالجة اتخاذ شكليات مسبقة كالحصول على ترخيص أو تصريح قبل معالجة هذه البيانات، و كذلك اتخاذ مجموعة من التدابير لتوفير أكبر قدر ممكن من الحماية لهذه البيانات، و مخالفة هذه القواعد الشكلية يعد جريمة معاقب عليها. |
