النظام القانوني للسكن الترقوي العمومي بالجزائر

Abstract

تتمثل الصيغ السكنية في اطار التملك في سكن البيع بالإيجار، الدي يجعل الفرد يتملك مسكنه بعد مدة من الايجار ، مقابل دفع اقساط شهرية ،يكون مجموعها ثمن السكن ، و تتمثل الالية القانونية لاقتنائه في عقد البيع بالإيجار ، و توجه هده الصيغة السكنية الى الطبقة الاجتماعية المتوسطة ، شانها في دلك شان صيغة السكن الترقوي المدعم ، حيث يتم اقتناء سكن في اطار هده الصيغة عن طريق عقد اليع على التصاميم دون سواه ، اما بالنسبة للطبقة الميسورة الحال نوعا ما ، فقد خصها المشرع هي الاخرى في اطار تحقيق العدالة الاجتماعية ، بصيغة سكنية لا تستفيد من الاعانة المباشرة التي تمنحها الدولة ، لكن تستفيد من اعانات غير مباشرة ، كالتخفيض في قيمة الوعاء العقاري الدي سيقام عليه المشروع ، وتتكفل الدولة بأشغال الطرقات و الشبكات ، ناهيك عن تمكين المواطن من الحصول على قرض عقاري مخفض القيمة.

ABSTRACT Résidential formulas within the framework of ownership are represented in sale by leasehousing ,whichmakes the individualownher home after a period of rent , in return for payingmonthlyinstallments ,the total of which in the price of the house. The legalmechanism for its acquisition is the lease-sale contract , and thishousing formula isdirected to the middle social class , justlike the subsidizedpromotionalhousing formula , thence a housingisacquiredwithing the framework of this formula through a sales contractbased on designs only . As for the somewhat affluent class the legislatoralsosingled dit out in the context of achieving social justice with a housing formula thatdoesbenefitfromsubsidygranted by the state . Ratheritbenefitsfrom cross-subsidies . Such as a reduction in the value of the real estate container on wich the progectwillbebuilt . routes and networking orogectsguaranteed by the state .not to mention enabling the citizen to obtain a low – value real astate loan.
