dc.description	The types of crimes varied over the ages and developed with the development of man, as they included all areas of his life, and the types of criminals also differed according to social studies into several types, the most prominent of which was the return criminal, who is the one who used to commit crimes and his conscience separated from him, and this was the subject of our study by addressing crimes Habitualism in the Algerian Penal Code, which are crimes that mean the repetition of the same criminal act at least twice during a period of time, which the legislator left to determine to the criminal judge. Where did the legislator consider the element of habit as a condition and not as a cornerstone in these crimes, and also as an aggravating circumstance for punishment only.	en_US
dc.description.abstract	إختلفت أنواع الجرائم على مر العصور وتطورت مع تطور الإنسان حيث شملت كل مجالات حياته، وإختلف أيضا أنواع المجرمون حسب الدراسات الاجتماعية إلى عدة أنواع كان أبرزها المجرم العائد، وهو من تعود على إرتكاب الجرائم وإنفصل عنه ضميره، وهذا كان موضوع دراستنا من خلال التطرق إلى جرائم الإعتياد في قانون العقوبات الجزائري، وهي الجرائم التي تعني تكرار نفس الفعل الإجرامي مرتين على الأقل خلال مدة زمنية ترك المشرع تحديدها للقاضي الجزائي، وأهم الجرائم التي ذكرت في قانون العقوبات هي جرائم التسول والتشرد، جرائم الوساطة في الدعارة، الإعتياد في جرائم الإجهاض وتبيض الأموال، أين إعتبر المشرع عنصر الإعتياد كشرط وليس كركن في هذه الجرائم، وأيضا كظرف مشدد للعقوبة فقط.	en_US
