dc.description	The legislator has guaranteed the rights of the accused who is absent from the court session with legal and judicial guarantees and made it a legal obligation that falls on the criminal judge, such as reasoning judgments, for example, as being part of public order because it is considered a preventive means that enables litigants and courts of appeal to monitor procedural activity. As for the opposition, it is a way and a means that enables the accused to notify His vote for the court and its aim is to reconsider the case before the same body that issued the ruling. As for the judicial guarantees, it is firstly to confirm the presumption of innocence and the extent to which it protects the accused even if he is absent from the court session, it remains attached to him, as well as defenses related to public order that also have a role in protecting the right of the accused	en_US
dc.description.abstract	لقد كفل المشرع حقوق المتهم الغائب عن جلسة المحاكمة بضمانات قانونية وأخرى قضائية، وجعلها بمثابة إلتزام قانوني يقع على عاتق القاضي الجنائي كالتسبيب الأحكام مثال، باعتباره من النظام العام لأنه يعتبر وسيلة وقائية تمكن الخصوم ومحاكم الطعن بمراقبة النشاط الإجرائي، أما بالنسبة للمعارضة في طريق ووسيلة تمكن المتهم من تبليغ صوته للمحكمة وهدفها إعادة النظر في الدعوى أمام نفس الجهة التي أصدرت الحكم، وأما بالنسبة للضمانات القضائية تتمثل أولا في التأكيد على قرينة البراءة ومدى حمايتها للمتهم حتى وإن غاب عن جلسة المحاكمة تبقى مقترنة به، وكذلك الدفوع المتعلقة بالنظام العام التي لها دور أيضا في حماية حق المتهم.	en_US
