dc.description	The criminal proof is based on a number of means among which, testimony is the most important evidence as it plays a role in justifying the proof in front of justice since through this proof the witness conveys the events and the facts that he has seen happening, and for that reason he plays an important role in the public lawsuit. In order to afford his testimony that the judge adopts to have conviction according to judgments based on reality, that is why the Algerian legislator has set up a number of rights and obligations. The witness takes full penal responsibility in case he fails to respect his obligations and then he could be subject to sanctions according the penal procedures and the penal code. He will be asked, in case of failure of his duties to carry out testimony since it is the main obligation, and also in case of deliberate distortion of the truth, the fact that is considered as a crime or perjury owing to its considered as infringement of the sanctity of private life.	en_US
dc.description.abstract	يرتكز الإثبات الجنائي على مجموعة من الوسائل وتعد الشهادة أبرزها لما لها من دور في إقامة الدليل أمام القضاء، إذ من خلالها ينقل الشاهد أحداثا ومجريات شهد على ارتكابها، فيكتسب بذلك مركزا مهما في الدعوى العمومية وفي سبيل تقديمه لشهادة يمكن أن يعتمد عليها القاضي لتكوين قناعته وبناء أحكام مبنية على الحقيقة، أقر له المشرع الجزائري جملة من الحقوق وفرض عليه بالمقابل مجموعة من الواجبات. يتحمل الشاهد المسؤولية الجنائية في حال إخلاله بالالتزامات الملقاة على عاتقه، وتفرض عليه عقوبات حددها المشرع في نصوص قانون الإجراءات الجزائية وقانون العقوبات، فيسأل عند إخلاله بإلزام أداء الشهادة كونه الالتزام الرئيسي، وكذا في حال تحريفه للشهادة والتي يترتب عنها جريمة شهادة الزور التي قرر لها المشرع عقوبات ردعية نظرا لخطورتها ومساسها بمصالح الأفراد والمجتمع.	en_US
