dc.description	From what was discussed in this memorandum, we conclude that theAlgerian legislator did not hesitate to provide for the crimes of abuseof power in the penal code. It is a serious crime because of the resulting violation of rights andfreedoms and constitutes a serious violation of the integrity of the job.The Algerian legislator has criminalized forms of abuse of power andhas adopted a number of punitive and procedural texts to punish theperpetrators of these crimes. Although there are a range of similar crimes, there are somedifferences that distinguish a crime from abuse of power.The public servant's abuse of power is the main focus of itsestablishment alongside the rest of the staff and therefore the abuse ofor her functional authority by the public official is his or herresponsibility and is therefore a criminal or disciplinary liability.	en_US
dc.description.abstract	من خلال ما تم التطرق إليه في هذه المذكرة نستنتج أن المشرع الجزائري لم يتوانى فيالنص على جرائم إساءة إستعمال السلطة في قانون العقوبات.فهي تعتبر من الجرائم الخطيرة نظرا لما يترتب عنها من إهدار للحقوق والحريات كماأنها تشكل إنتهاكا جسيما لنزاهة الوظيفة فقد جرم المشرع الجزائري صور إساءة إستعمالالسلطة كما أقر جملة من النصوص العقابية والإجرائية لمعاقبة مرتكبي هذه الجرائم.وبالرغم من أن هناك مجموعة من الجرائم المشابهة لها إلا أن هناك بعض الإختلافاتالتي تميز جريمة عن جرائم إساءة إستعمال السلطة. إذ يشكل الموظف العام في إساءة إستعمال السلطة المحور الأساسي لقيامها إلى جانببقيـة الأركـان وعليـه فإساءة الموظف العمومي إستعمال سلطته الوظيفيـة تقـوم مسؤوليتهويستوي في ذلك أن تكون مسؤولية جزائية أو تأديبية.	en_US
