Abstract:
لقد تناولنا في هذه الدراسة موضوع الحماية الجنائية لحرمة المسكن بهدف تبيان الحماية التي اقرها المشرع الجزائري لأي انتهاك يقع على حرمة المسكن ذلك أن المسكن بالنسبة لأي منا هو محل الأمن والملجأ الذي يحميه ويبعث في نفسه الطمأنينة وعليه فان كل اعتداء عليه يعد اعتداء على هدوء وامن الإنسان في المنزل الذي يسكنه كما أن من حق صاحبه منع الغير من دخوله للاطلاع على أسرار حياته الخاصة أيا كانت طبيعتها.
كما أن الاعتداء قد يقع من طرفين سواء كان اعتداء من طرف الشخص العادي وهنا وضع المشرع أحكام وقوانين تحكم هذه الجريمة من خلال تقرير عقوبة لكل من يرتكب هذه الجريمة عن طريق دخول إلى مسكن الغير على وجه حق وهذا في الفصل الأول أما الفصل الثاني فقد خصصناه لجريمة اعتداء على حرمة المسكن من طرف الموظف من خلال إساءة استعمال سلطته، وهنا أيضا وضع المشرع أحكام وقوانين تضبط وتوضح دخول الموظف إلى مسكن الغير وهذا من خلال القيام بعملية التفتيش في إطار قواعد و أحكام تضبطه وعند مخالفته لهذه القوانين أعتبر الموظف بأنه ارتكب جريمة اعتداء حرمة مسكن و أقر له المشرع عقوبة حسب المادة 135 من قانون العقوبات الجزائري.

We have dealt in this study with the issue of criminal protection for the sanctity of the home in order to show the protection approved by the Algerian legislator for any violation of the sanctity of the home, because the home for any of us is the place of security and refuge that protects him and gives him reassurance, and therefore every attack on it is an attack on the calm and security of the human being In the house in which he lives, and the owner has the right to prevent others from entering it to learn the secrets of his private life, whatever its nature.
Also, the assault may occur from two parties, whether it was an assault by the ordinary person, and here the legislator set provisions and laws governing this crime by deciding a penalty for each person who commits this crime by entering the residence of others in the right way, and this is in the first chapter. As for the second chapter, we have allocated it to a crime An assault on the sanctity of the home by the employee through the abuse of his authority. Here, too, the legislator established provisions and laws that control and clarify the employee’s entry to the residence of others, and this is through carrying out the inspection process within the framework of rules and provisions that control him, and when he violates these laws, the employee is considered to have committed a crime of assaulting the sanctity of a residence And the legislator approved a penalty for him according to Article 135 of the Algerian Penal Code.
